For translation or more information on this topic, please contact author.<\/h4>\n<p>&nbsp;<\/p>\n<h2>Souhrn<\/h2>\n<p>Nov\u00fd metodick\u00fd p\u0159\u00edstup stanoven\u00ed minim\u00e1ln\u00edch z\u016fstatkov\u00fdch pr\u016ftok\u016f (d\u00e1le jen MZP) slou\u017e\u00ed jako podklad pro na\u0159\u00edzen\u00ed vl\u00e1dy \u010cR a\u00a0samoz\u0159ejm\u011b vyvol\u00e1v\u00e1 \u0161irokou diskusi nad jeho dopadem, a\u00a0to jak z\u00a0hlediska ochrany p\u0159\u00edrody, tak rovn\u011b\u017e, a\u00a0to p\u0159edev\u0161\u00edm, z\u00a0hlediska jeho dopadu na nakl\u00e1d\u00e1n\u00ed s\u00a0vodami a\u00a0hospoda\u0159en\u00ed na n\u00e1dr\u017e\u00edch. U\u017e v\u00a0po\u010d\u00e1tc\u00edch \u0159e\u0161en\u00ed a\u00a0hled\u00e1n\u00ed nov\u00e9ho p\u0159\u00edstupu bylo jasn\u00e9, \u017ee nebude mo\u017en\u00e9 naj\u00edt ide\u00e1ln\u00ed rovnov\u00e1hu a\u00a0uspokojit v\u0161echny z\u00fa\u010dastn\u011bn\u00e9. Problematika MZP toti\u017e vyvol\u00e1v\u00e1 p\u0159irozen\u00fd rozkol mezi nakl\u00e1d\u00e1n\u00edm s\u00a0vodami a\u00a0ochranou p\u0159\u00edrody a\u00a0jen u\u00a0minima p\u0159\u00edpad\u016f lze nal\u00e9zt ide\u00e1ln\u00ed kompromis. Dosud platn\u00fd metodick\u00fd pokyn z\u00a0roku 1998 je \u00fam\u011brn\u00fd sv\u00e9 dob\u011b, ale nevyhovuje po\u017eadavk\u016fm na tzv. ekologick\u00e9 pr\u016ftoky, rovn\u011b\u017e v\u00fdpo\u010det sm\u011brn\u00fdch hodnot ve skokov\u00e9m re\u017eimu nelze pova\u017eovat za spravedliv\u00fd. Nov\u00fd p\u0159\u00edstup je zalo\u017een na region\u00e1ln\u00edm rozd\u011blen\u00ed respektuj\u00edc\u00ed hranice povod\u00ed a\u00a0odli\u0161n\u00e9 hydrologicko-geologick\u00e9 charakteristiky. Do v\u00fdpo\u010dtu MZP zav\u00e1d\u00ed v\u00edce hydrologick\u00fdch charakteristik a\u00a0vytv\u00e1\u0159\u00ed podm\u00ednky pro sezonn\u00ed rozd\u011blen\u00ed MZP b\u011bhem roku.<\/p>\n<a href=\"https:\/\/www.vtei.cz\/wp-content\/uploads\/2018\/04\/ilustracni-fotografie-2.jpg\" rel=\"shadowbox[sbpost-4654];player=img;\"><img decoding=\"async\" width=\"800\" height=\"522\" class=\"alignnone size-full wp-image-4550 lazyload\" data-src=\"https:\/\/www.vtei.cz\/wp-content\/uploads\/2018\/04\/ilustracni-fotografie-2.jpg\" alt=\"\" data-srcset=\"https:\/\/www.vtei.cz\/wp-content\/uploads\/2018\/04\/ilustracni-fotografie-2.jpg 800w, https:\/\/www.vtei.cz\/wp-content\/uploads\/2018\/04\/ilustracni-fotografie-2-300x196.jpg 300w, https:\/\/www.vtei.cz\/wp-content\/uploads\/2018\/04\/ilustracni-fotografie-2-768x501.jpg 768w\" data-sizes=\"(max-width: 800px) 100vw, 800px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 800px; --smush-placeholder-aspect-ratio: 800\/522;\" \/><\/a>\n<p>\u010cl\u00e1nek p\u0159edkl\u00e1d\u00e1 souhrn posledn\u00ed verze zp\u016fsobu stanoven\u00ed hodnot minim\u00e1ln\u00edch z\u016fstatkov\u00fdch pr\u016ftok\u016f, dokumentuje zvolen\u00fd p\u0159\u00edstup a\u00a0porovn\u00e1v\u00e1 zm\u011bny hodnot MZP s\u00a0p\u016fvodn\u00edm metodick\u00fdm pokynem z\u00a0roku 1998.<\/p>\n<h2>\u00davod<\/h2>\n<p>Novela z\u00e1kona \u010d. 254\/2001 Sb. z\u00a0roku 2010 byla z\u00e1sadn\u00edm impulsem pro p\u0159ehodnocen\u00ed dosavadn\u00edho p\u0159\u00edstupu k\u00a0problematice minim\u00e1ln\u00edch z\u016fstatkov\u00fdch pr\u016ftok\u016f. Novela \u00a7 36 stanovila, \u017ee zp\u016fsob a\u00a0krit\u00e9ria stanoven\u00ed minim\u00e1ln\u00edho z\u016fstatkov\u00e9ho pr\u016ftoku podle druh\u00e9ho odstavce stanov\u00ed vl\u00e1da na\u0159\u00edzen\u00edm. M\u017dP \u010cR n\u00e1sledn\u011b pov\u011b\u0159ilo V\u00daV TGM, v. v. i., p\u0159ehodnocen\u00edm dosavadn\u00edho p\u0159\u00edstupu pou\u017e\u00edvan\u00e9m v\u00a0metodick\u00e9m pokynu M\u017dP \u010cR z\u00a0roku 1998. V\u00daV TGM, v. v. i., byl z\u00e1rove\u0148 pov\u011b\u0159en, aby do zp\u016fsobu stanoven\u00ed MZP implementoval nov\u00e9 postupy a\u00a0krit\u00e9ria, kter\u00e1 by v\u00edce zohled\u0148ovala hydrologickou variabilitu jednotliv\u00fdch region\u016f\u00a0\u010cR, sezonn\u011b rozd\u011blila velikost MZP b\u011bhem roku a\u00a0posoudila velikost MZP z\u00a0hlediska tzv. ekologick\u00fdch pr\u016ftok\u016f.<\/p>\n<p>Minim\u00e1ln\u00edm z\u016fstatkov\u00fdm pr\u016ftokem se podle \u00a7 36 vodn\u00edho z\u00e1kona rozum\u00ed pr\u016ftok povrchov\u00fdch vod, kter\u00fd je\u0161t\u011b umo\u017e\u0148uje obecn\u00e9 nakl\u00e1d\u00e1n\u00ed s\u00a0vodami a\u00a0ekologick\u00e9 funkce vodn\u00edho toku. Vodn\u00ed z\u00e1kon v\u00a0platn\u00e9m zn\u011bn\u00ed ukl\u00e1d\u00e1 vodopr\u00e1vn\u00edm \u00fa\u0159ad\u016fm stanovit hodnotu minim\u00e1ln\u00edho z\u016fstatkov\u00e9ho pr\u016ftoku s\u00a0p\u0159ihl\u00e9dnut\u00edm k\u00a0podm\u00ednk\u00e1m vodn\u00edho toku, charakteru nakl\u00e1d\u00e1n\u00ed s\u00a0vodami a\u00a0k\u00a0opat\u0159en\u00edm k\u00a0dosa\u017een\u00ed c\u00edl\u016f ochrany vod p\u0159ijat\u00fdch v\u00a0pl\u00e1nu povod\u00ed. Tyto po\u017eadavky dan\u00e9 z\u00e1konem bylo t\u0159eba zohlednit v\u00a0n\u00e1vrhu nov\u00e9ho metodick\u00e9ho p\u0159\u00edstupu, kter\u00fd bude slou\u017eit jako podklad pro zpracov\u00e1n\u00ed na\u0159\u00edzen\u00ed vl\u00e1dy. Nov\u011b navr\u017een\u00fd koncept vych\u00e1z\u00ed z\u00a0doposud platn\u00e9ho metodick\u00e9ho pokynu Odboru ochrany vod Ministerstva \u017eivotn\u00edho prost\u0159ed\u00ed k\u00a0z\u00e1sad\u00e1m stanoven\u00ed hodnot minim\u00e1ln\u00edch z\u016fstatkov\u00fdch pr\u016ftok\u016f ve vodn\u00edch toc\u00edch z\u00a0roku 1998 [1]. S\u00a0c\u00edlem lep\u0161\u00edho zohledn\u011bn\u00ed po\u017eadavk\u016f vodn\u00edch ekosyst\u00e9m\u016f, ekosyst\u00e9m\u016f v\u00e1zan\u00fdch na vodn\u00ed prost\u0159ed\u00ed, environment\u00e1ln\u00edch standard\u016f pou\u017e\u00edvan\u00fdch v\u00a0jin\u00fdch zem\u00ed EU a\u00a0po\u017eadavk\u016f M\u017dP\u00a0\u010cR, byl oproti p\u016fvodn\u00edmu pokynu uplatn\u011bn region\u00e1ln\u00ed p\u0159\u00edstup ke stanoven\u00ed hodnoty MZP. Hodnota MZP je prom\u011bnn\u00e1 v\u00a0roce a\u00a0p\u0159i jej\u00edm stanoven\u00ed se p\u0159ihl\u00ed\u017e\u00ed i\u00a0k\u00a0c\u00edli ochrany vod pro dot\u010den\u00fd vodn\u00ed \u00fatvar.<\/p>\n<p>Velikost minim\u00e1ln\u00edho z\u016fstatkov\u00e9ho pr\u016ftoku m\u00e1 zna\u010dn\u00fd vliv na ekologick\u00fd i\u00a0na chemick\u00fd stav vodn\u00edho \u00fatvaru dot\u010den\u00e9ho nakl\u00e1d\u00e1n\u00edm s\u00a0vodami, nebo\u0165 zaji\u0161\u0165uje p\u0159e\u017eit\u00ed vodn\u00edch a\u00a0na vodu v\u00e1zan\u00fdch ekosyst\u00e9m\u016f v\u00a0obdob\u00ed sucha a\u00a0zaji\u0161\u0165uje dostate\u010dn\u00e9 \u0159ed\u011bn\u00ed vypou\u0161t\u011bn\u00fdch vod. V\u00a0tomto kontextu je mo\u017en\u00e9 se v\u00a0literatu\u0159e setkat s\u00a0term\u00ednem ekologick\u00fd (environment\u00e1ln\u00ed) pr\u016ftok. Velikost ekologick\u00e9ho pr\u016ftoku je zpravidla stanovov\u00e1na na z\u00e1klad\u011b znalosti specifik dan\u00e9 lokality, ke kter\u00fdm pat\u0159\u00ed nap\u0159. struktura ekosyst\u00e9mu (p\u0159eva\u017euj\u00edc\u00ed, chr\u00e1n\u011bn\u00e9 druhy organism\u016f a\u00a0rostlin), hydromorfologie dot\u010den\u00e9ho \u00faseku toku, v\u00fdskyt habitat\u016f atd. Pro stanoven\u00ed velikosti ekologick\u00e9ho pr\u016ftoku existuje \u0159ada expertn\u00edch metod, kter\u00e9 v\u0161ak v\u00a0ka\u017ed\u00e9m p\u0159\u00edpad\u011b vy\u017eaduj\u00ed odborn\u00e9 posouzen\u00ed konkr\u00e9tn\u00ed lokality a\u00a0jsou \u010dasto \u010dasov\u011b i\u00a0finan\u010dn\u011b n\u00e1ro\u010dn\u00e9. Nen\u00ed tedy mo\u017en\u00e9 je doporu\u010dit pro rutinn\u00ed stanoven\u00ed hodnoty MZP vodopr\u00e1vn\u00edm \u00fa\u0159adem pro v\u0161echna povolovan\u00e1 nakl\u00e1d\u00e1n\u00ed s\u00a0vodami. P\u0159i odvozen\u00ed nov\u00e9 metodiky stanoven\u00ed MZP byla snaha p\u0159ibl\u00ed\u017eit se co nejv\u00edce konceptu ekologick\u00e9ho pr\u016ftoku [2], ale z\u00e1rove\u0148 vypracovat metodu uplatnitelnou v\u00a0praxi.<\/p>\n<h2>Data<\/h2>\n<p>Pro n\u00e1vrh nov\u00e9ho zp\u016fsobu stanoven\u00ed MZP byly k\u00a0dispozici statistick\u00e9 charakteristiky pr\u016ftok\u016f pro 276 vodom\u011brn\u00fdch stanic z\u00a0cel\u00e9 \u010cR za\u00a0obdob\u00ed 1981\u20132010, kter\u00e9 byly po\u0159\u00edzeny od \u010cesk\u00e9ho hydrometeorologick\u00e9ho \u00fastavu (\u010cHM\u00da). Sledovan\u00e9 charakteristiky zahrnovaly velikost dlouhodob\u00e9ho ro\u010dn\u00edho pr\u016fm\u011brn\u00e9ho pr\u016ftoku, p-procentn\u00ed a\u00a0M-denn\u00ed pr\u016ftoky, koeficient variace a\u00a0asymetrie \u0159ady denn\u00edch pr\u016ftok\u016f, hodnoty pr\u016fm\u011brn\u00e9ho pr\u016ftoku v\u00a0jednotliv\u00fdch m\u011bs\u00edc\u00edch v\u00a0roce a\u00a0hodnoty pravd\u011bpodobnostn\u00edho pole pr\u016fm\u011brn\u00fdch m\u011bs\u00ed\u010dn\u00edch pr\u016ftok\u016f. Division of the Czech Republic into 4 categories according to K99<\/h6>\n<p>\u010cHM\u00da stanovuje M-denn\u00ed pr\u016ftoky na z\u00e1klad\u011b pozorovan\u00fdch hodnot, kter\u00e9 odpov\u00eddaj\u00ed p\u0159irozen\u00e9mu nebo v\u00edce \u010di m\u00e9n\u011b ovlivn\u011bn\u00e9mu hydrologick\u00e9mu re\u017eimu. I\u00a0kdy\u017e je pro v\u00fdpo\u010det MZP doporu\u010deno vych\u00e1zet pr\u00e1v\u011b z\u00a0odovlivn\u011bn\u00fdch hodnot hydrologick\u00fdch charakteristik, bylo nutno p\u0159istoupit k\u00a0pragmatick\u00e9mu \u0159e\u0161en\u00ed a\u00a0ve v\u00fdsledn\u00e9m na\u0159\u00edzen\u00ed vl\u00e1dy budou pou\u017eity pouze hydrologick\u00e9 charakteristiky odvozen\u00e9 z\u00a0pozorovan\u00fdch, tedy mnohdy ovlivn\u011bn\u00fdch, pr\u016ftok\u016f. Tento pragmatick\u00fd p\u0159\u00edstup byl v\u00a0po\u010d\u00e1tc\u00edch pova\u017eov\u00e1n za jedin\u00fd mo\u017en\u00fd, ale postupem \u010dasu byl siln\u011b kritizov\u00e1n, a\u00a0to p\u0159edev\u0161\u00edm v\u00a0souvislosti se stanoven\u00edm MZP na vodn\u00edch d\u00edlech slou\u017e\u00edc\u00edch k\u00a0akumulaci vod.<\/p>\n<h2>N\u00e1vrh region\u00e1ln\u00edho rozd\u011blen\u00ed \u010cR<\/h2>\n<p>Zohledn\u011bn\u00ed p\u0159\u00edrodn\u00edch podm\u00ednek toku p\u0159i n\u00e1vrhu regionalizace \u010cR bylo zalo\u017eeno p\u0159edev\u0161\u00edm na uv\u00e1\u017een\u00ed kl\u00ed\u010dov\u00fdch proces\u016f pod\u00edlej\u00edc\u00edch se na tvorb\u011b celkov\u00e9ho odtoku z\u00a0povod\u00ed. Bylo t\u0159eba vymezit oblasti, kde si celkov\u00fd odtok po v\u011bt\u0161inu roku zachov\u00e1v\u00e1 vyrovnan\u00fd charakter, a\u00a0tedy nedoch\u00e1z\u00ed k\u00a0v\u00fdrazn\u00e9mu poklesu vodnosti toku v\u00a0l\u00e9t\u011b a\u00a0na za\u010d\u00e1tku podzimu. Jedn\u00e1 se p\u0159edev\u0161\u00edm o\u00a0oblasti, kde je celkov\u00fd odtok po v\u011bt\u0161inu roku dotov\u00e1n ze z\u00e1sob podzemn\u00edch vod. Na druhou stranu bylo t\u0159eba vymezit oblasti, kter\u00e9 mohou b\u00fdt potenci\u00e1ln\u011b zraniteln\u00e9 v\u016f\u010di suchu, kde je celkov\u00fd odtok b\u011bhem roku v\u00fdrazn\u011b nevyrovnan\u00fd. Na z\u00e1klad\u011b souvislosti hodnot parametru K99, hydrogeologick\u00fdch pom\u011br\u016f a\u00a0nadmo\u0159sk\u00e9 v\u00fd\u0161ky bylo navr\u017eeno rozd\u011blit \u00fazem\u00ed \u010cR do \u010dty\u0159 kategori\u00ed. Samostatnou t\u0159\u00eddu tvo\u0159\u00ed kategorie k\u0159\u00eddov\u00fdch sediment\u016f, kter\u00e9 p\u0159edstavuj\u00ed dren\u00e1\u017en\u00ed b\u00e1ze a\u00a0kde z\u00e1kladn\u00ed odtok, tj. odtok ze z\u00e1sob podzemn\u00edch vod, tvo\u0159\u00ed podstatnou \u010d\u00e1st celkov\u00e9ho odtoku. Pat\u0159\u00ed sem n\u011bkter\u00e9 p\u0159\u00edtoky Labe, horn\u00ed Metuje, Lou\u010dn\u00e1, pramenn\u00e9 oblasti Svitavy a\u00a0T\u0159eb\u016fvky a\u00a0tok \u0158\u00ed\u010dka. Hodnota parametru K99 je v\u00a0t\u011bchto oblastech zpravidla v\u011bt\u0161\u00ed ne\u017e 0,18. Vyrovnan\u00fd charakter odtoku je zde d\u00e1n p\u0159edev\u0161\u00edm vysok\u00fdmi sr\u00e1\u017ekami. Hodnota parametru K99 je v\u00a0t\u011bchto \u00fazem\u00edch zpravidla v\u011bt\u0161\u00ed ne\u017e 0,15. Do t\u00e9to t\u0159\u00eddy byly za\u0159azeny p\u0159edev\u0161\u00edm Krkono\u0161e a\u00a0Jizersk\u00e9 hory, \u0160umava, Jesen\u00edky, vrcholky Kru\u0161n\u00fdch hor a\u00a0d\u00e1le i\u00a0\u010d\u00e1st povod\u00ed Tich\u00e9 Orlice, kter\u00e1 m\u00e1 obdobn\u011b vyrovnan\u00fd charakter. T\u0159et\u00ed kategorii p\u0159edstavuj\u00ed oblasti tvo\u0159en\u00e9 p\u0159ev\u00e1\u017en\u011b krystalinick\u00fdmi strukturami, kter\u00e9 se nach\u00e1zej\u00ed v\u00a0podh\u016f\u0159\u00ed pohrani\u010dn\u00edch poho\u0159\u00ed a\u00a0v\u00a0oblasti \u010ceskomoravsk\u00e9 vrchoviny. Jedn\u00e1 se o\u00a0\u00fazem\u00ed s\u00a0velmi podobn\u00fdm pr\u016fb\u011bhem \u010d\u00e1ry p\u0159ekro\u010den\u00ed jako u\u00a0t\u0159\u00eddy 2. Vzhledem k\u00a0ni\u017e\u0161\u00ed nadmo\u0159sk\u00e9 v\u00fd\u0161ce, ne\u017e kter\u00e1 je dosahov\u00e1na v\u00a0oblastech kategorie 2, zde doch\u00e1z\u00ed k\u00a0d\u0159\u00edv\u011bj\u0161\u00edmu n\u00e1stupu obdob\u00ed jarn\u00edho t\u00e1n\u00ed. Tak\u00e9 sr\u00e1\u017eky jsou zde ni\u017e\u0161\u00ed ne\u017e u\u00a0kategorie 2. Hodnota parametru K99 se v\u00a0t\u011bchto oblastech zpravidla pohybuje od 0,1 do 0,15. Do \u010dtvrt\u00e9 kategorie byly klasifikov\u00e1ny oblasti, kter\u00e9 se vyzna\u010duj\u00ed v\u00fdrazn\u011b nevyrovnan\u00fdm re\u017eimem pr\u016ftok\u016f b\u011bhem roku, kde hodnota parametru K99 je men\u0161\u00ed ne\u017e 0,1. Mapa rozd\u011blen\u00ed \u010cR do jednotliv\u00fdch kategori\u00ed je na <em>obr.\u00a01<\/em>.<\/p>\n<h2>N\u00e1vrh zp\u016fsobu stanoven\u00ed MZP podle nov\u00fdch krit\u00e9ri\u00ed<\/h2>\n<p>Navr\u017een\u00fd zp\u016fsob stanoven\u00ed MZP m\u00e1 dostate\u010dn\u011b respektovat pot\u0159eby vodn\u00edch ekosyst\u00e9m\u016f a\u00a0ekosyst\u00e9m\u016f na vodu v\u00e1zan\u00fdch. V\u00a0prvn\u00ed \u0159ad\u011b byl proveden rozbor existuj\u00edc\u00edch studi\u00ed zam\u011b\u0159en\u00fdch na stanoven\u00ed hodnoty MZP s\u00a0vyu\u017eit\u00edm expertn\u00ed metody \u201eInstream Flow Incremental Methodology\u201c (d\u00e1le jen IFIM) [3] v\u00a0podm\u00ednk\u00e1ch \u010cR. Jedn\u00e1 se o\u00a0metodu, kter\u00e1 vyu\u017e\u00edv\u00e1 pro stanoven\u00ed hodnoty MZP v\u00fdsledky rekognoskace z\u00e1jmov\u00e9ho \u00faseku toku z\u00a0hlediska jeho hydraulick\u00fdch parametr\u016f, charakteru habitatu a\u00a0vyskytuj\u00edc\u00edch se \u017eivo\u010di\u0161n\u00fdch a\u00a0rostlinn\u00fdch druh\u016f. Metoda zahrnuje simulaci v\u00e1\u017een\u00e9 vyu\u017eiteln\u00e9 plochy habitatu p\u0159i r\u016fzn\u011b velk\u00fdch pr\u016ftoc\u00edch. V\u00fdsledky simula\u010dn\u00edho modelov\u00e1n\u00ed pomoc\u00ed modelu Phabsim (modelov\u00fd n\u00e1stroj metodiky IFIM) jsou d\u00e1le uplatn\u011bny p\u0159i diskusi nad volbou kompromisn\u00ed \u00farovn\u011b MZP, kter\u00e1 umo\u017en\u00ed zachov\u00e1n\u00ed st\u00e1vaj\u00edc\u00edch ekosyst\u00e9m\u016f a\u00a0z\u00e1rove\u0148 umo\u017en\u00ed rozumnou m\u00edru nakl\u00e1d\u00e1n\u00ed s\u00a0vodami [4]. Odvozen\u00ed hodnoty MZP pomoc\u00ed metody IFIM trv\u00e1 zpravidla 1,5 a\u017e 2\u00a0roky a\u00a0vy\u017eaduje opakovan\u00fd sb\u011br biologick\u00fdch a\u00a0hydraulicko-hydrologick\u00fdch dat z\u00a0\u00faseku toku, kter\u00fd bude dot\u010den\u00fd navrhovan\u00fdm nakl\u00e1d\u00e1n\u00edm. Pro tyto kategorie plat\u00ed, \u017ee hodnota Q<sub>330d<\/sub> \u010din\u00ed p\u0159ibli\u017en\u011b 26\u201331\u00a0% Q<sub>a<\/sub> (viz <em>tabulku<\/em>\u00a0<em>1<\/em>). Z\u00a0tabulky je rovn\u011b\u017e patrn\u00e9, \u017ee pro kategorii 1 odpov\u00edd\u00e1 pr\u016ftoku o\u00a0velikosti 30\u00a0% Q<sub>a<\/sub>, pr\u016ftok s\u00a0dobou p\u0159ekro\u010den\u00ed 364\u00a0dn\u00ed v\u00a0roce, zat\u00edmco pro stanice v\u00a0za\u0159azen\u00e9 do kategorie 4 by se jednalo o\u00a0pr\u016ftok s\u00a0dobou p\u0159ekro\u010den\u00ed p\u0159ibli\u017en\u011b 300 a\u017e 270\u00a0dn\u00ed v\u00a0roce. Pro n\u00e1vrh metody stanoven\u00ed MZP byl d\u00e1le uva\u017eov\u00e1n orienta\u010dn\u00ed po\u017eadavek, aby MZP \u010dinilo p\u0159ibli\u017en\u011b 20\u201330\u00a0% Q<sub>a<\/sub>. Tento po\u017eadavek je v\u00a0souladu se z\u00e1v\u011bry dokumentu \u201eEnvironmental Flows as a\u00a0tool to achieve the WFD Objectives \u2013 discussion paper\u201c [5]. V\u00a0prvn\u00edch pracovn\u00edch verz\u00edch tohoto dokumentu bylo doporu\u010deno pro dosa\u017een\u00ed dobr\u00e9ho ekologick\u00e9ho stavu zajistit ekologick\u00fd pr\u016ftok v\u00a0rozsahu 25\u201350\u00a0% Q<sub>a<\/sub>, navr\u017een\u00e1 \u00farove\u0148 20\u201330\u00a0% tedy p\u0159edstavuje doln\u00ed hranici z\u00a0dan\u00e9ho rozp\u011bt\u00ed. Nicm\u00e9n\u011b, zde je nutno podotknout, \u017ee v\u00a0sou\u010dasn\u00e9 dob\u011b ji\u017e nejsou tyto hodnoty v\u00a0dokumentu uv\u00e1d\u011bny. Vzhledem k\u00a0v\u00fd\u0161e uveden\u00fdm fakt\u016fm bylo rozhodnuto, \u017ee v\u00fdpo\u010det MZP bude odvozov\u00e1n od hodnoty pr\u016ftoku s\u00a0pravd\u011bpodobnost\u00ed p\u0159ekro\u010den\u00ed 330\u00a0dn\u00ed v\u00a0roce.<\/p>\n<h5>Tabulka 1. Podobn\u00fd p\u0159\u00edstup je rovn\u011b\u017e uplatn\u011bn nap\u0159. ve \u0161v\u00fdcarsk\u00e9m vodn\u00edm z\u00e1kon\u011b [6], kde velikost minim\u00e1ln\u00edho z\u016fstatkov\u00e9ho pr\u016ftoku (residual water flow) roste v\u00a0z\u00e1vislosti na hodnot\u011b pr\u016ftoku s\u00a0pravd\u011bpodobnost\u00ed p\u0159ekro\u010den\u00ed 347\u00a0dn\u00ed v\u00a0roce s\u00a0mocninou men\u0161\u00ed ne\u017e 1. Aby byl popsan\u00fd princip zachov\u00e1n i\u00a0v\u00a0nov\u011b navrhovan\u00e9 metodice stanoven\u00ed MZP, bylo nejprve provedeno vyhodnocen\u00ed z\u00e1vislosti pod\u00edlu pr\u016ftoku s\u00a0dobou p\u0159ekro\u010den\u00ed 330\u00a0dn\u00ed v\u00a0roce a\u00a0dlouhodob\u00e9ho pr\u016fm\u011brn\u00e9ho pr\u016ftoku Q<sub>a<\/sub> na velikosti pr\u016ftoku Q<sub>330d<\/sub>.<\/p>\n<p>Pro odvozen\u00ed vztahu vhodn\u00e9ho pro stanoven\u00ed MZP pro jednotliv\u00e9 kategorie byla vykreslena funkce pod\u00edlu n\u00e1vrhov\u00e9 hodnoty MZP\/Q<sub>330d<\/sub> na velikosti Q<sub>330d<\/sub> pro jednotliv\u00e9 kategorie zvl\u00e1\u0161\u0165. Nicm\u00e9n\u011b bylo rozhodnuto, \u017ee m\u00edra redukce velikosti MZP v\u00a0z\u00e1vislosti na velikosti \u0159\u00eddic\u00edho pr\u016ftoku Q<sub>330d<\/sub> bude pro cel\u00e9 \u00fazem\u00ed \u010cR stejn\u00e1 a\u00a0rozd\u00edln\u00fd bude parametr n\u00e1sobku v\u00a0rovnici. V\u00fdsledn\u00e9 rovnice pro stanoven\u00ed MZP pro jednotliv\u00e9 kategorie byly odvozeny op\u011bt z\u00a0po\u017eadavku dosa\u017een\u00ed pom\u011bru MZP\/Q<sub>a<\/sub> p\u0159ibli\u017en\u011b na \u00farovni 25\u00a0%. V\u00fdsledn\u00e9 rovnice jsou uvedeny v\u00a0<em>tabulce 2<\/em>.<\/p>\n<p>Sou\u010d\u00e1st\u00ed zad\u00e1n\u00ed ze strany Ministerstva \u017eivotn\u00edho prost\u0159ed\u00ed bylo rovn\u011b\u017e rozd\u011blen\u00ed hodnoty MZP do minim\u00e1ln\u011b dvou obdob\u00ed, kter\u00e1 by tak v\u00edce popisovala rozd\u011blen\u00ed pr\u016ftoku b\u011bhem roku. T\u00edm by bylo zaji\u0161t\u011bno, \u017ee oproti p\u016fvodn\u00edmu metodick\u00e9mu pokynu by MZP nebyl konstantn\u00ed b\u011bhem cel\u00e9ho roku, ale v\u00a0jarn\u00edm obdob\u00ed by doch\u00e1zelo k\u00a0nav\u00fd\u0161en\u00ed MZP. V\u00fdsledn\u00fdm rozd\u011blen\u00edm MZP b\u011bhem roku bylo stanoven\u00ed tzv. hlavn\u00ed sezony v\u00a0obdob\u00ed kv\u011bten a\u017e leden a\u00a0jarn\u00ed sezony v\u00a0obdob\u00ed \u00fanor\u2013duben.<\/p>\n<h5>Tabulka 2. Anal\u00fdza byla provedena na 276 povod\u00edch v\u00a0\u010cesk\u00e9 republice. V\u011bt\u0161ina profil\u016f m\u00e1 v\u0161ak pr\u016fm\u011brn\u00fd pr\u016ftok do 2\u2008m<sup>3<\/sup>.s<sup>-1<\/sup>. Po n\u00e1vrhu byla na dan\u00fdch povod\u00edch provedena citlivostn\u00ed anal\u00fdza, kter\u00e1 m\u011bla za c\u00edl posoudit, zda v\u00a0jednotliv\u00fdch m\u011bs\u00edc\u00edch jsou navrhovan\u00e9 hodnoty MZP re\u00e1ln\u00e9 a\u00a0zda je mo\u017en\u00e9 v\u00a0m\u00e9n\u011b vodn\u00fdch m\u011bs\u00edc\u00edch t\u011bchto hodnot dos\u00e1hnout s\u00a0ur\u010ditou pravd\u011bpodobnost\u00ed. Pro posouzen\u00ed byly tak\u00e9 napo\u010d\u00edt\u00e1ny nedostatkov\u00e9 objemy s\u00a0konstantn\u00ed a\u00a0variabiln\u00ed limitn\u00ed hodnotou. Tyto nedostatkov\u00e9 objemy byly porovn\u00e1ny s\u00a0hodnotami nedostatkov\u00fdch objem\u016f, kde vstupem byla konstantn\u00ed limitn\u00ed hodnota platn\u00e9ho MZP. Na ose x jsou zobrazeny hodnoty Q<sub>330d <\/sub>a\u00a0na ose y jsou vyneseny hodnoty MZP. V\u00a0tomto p\u0159\u00edpad\u011b jsou zobrazena v\u0161echna hodnocen\u00e1 povod\u00ed. Na <em>obr.<\/em>\u00a0<em>3<\/em> jsou potom pouze povod\u00ed, jejich\u017e hodnota Q<sub>330d<\/sub> je men\u0161\u00ed nebo rovna 2\u2008m<sup>3<\/sup>.s<sup>-1<\/sup>, z\u00a0d\u016fvodu lep\u0161\u00ed prezentace v\u00fdsledk\u016f. Na tomto grafu je provedena sumarizace pro v\u0161echny kategorie. Lze pozorovat, \u017ee v\u0161echny navrhovan\u00e9 hodnoty jsou pod hodnotou Q<sub>330d<\/sub> a\u00a0v\u00a0p\u0159\u00edpad\u011b mal\u00fdch pr\u016ftok\u016f jsou rozd\u00edly minim\u00e1ln\u00ed a\u00a0d\u00e1 se uva\u017eovat, zda jsou tyto rozd\u00edly v\u016fbec m\u011b\u0159iteln\u00e9. Hodnoty jsou rozd\u011bleny do jednotliv\u00fdch kategori\u00ed (na ose x). Na ose y je potom procentu\u00e1ln\u00ed zm\u011bna od sou\u010dasn\u00e9 hodnoty pro v\u0161echna povod\u00ed \u0159e\u0161en\u00e1 v\u00a0dan\u00e9 kategorii. Na <em>obr. 7<\/em> jsou potom tyto zm\u011bny pro hlavn\u00ed sezonu rozlo\u017eeny do plochy \u010cesk\u00e9 republiky. Lze pozorovat, \u017ee zm\u011bny pro hlavn\u00ed sezonu (\u010derven\u011b) se pr\u016fm\u011brn\u011b pohybuj\u00ed od 25\u00a0% pro kategorii 1 do cca 20\u00a0% u\u00a0kategorie\u00a02. U\u00a0sezony vedlej\u0161\u00ed jsou tyto zm\u011bny cca o\u00a020\u00a0% vy\u0161\u0161\u00ed.<\/p>\n<h2>V\u00fdsledky a\u00a0diskuse<\/h2>\n<p>Nov\u00fd p\u0159\u00edstup stanoven\u00ed minim\u00e1ln\u00edch z\u016fstatkov\u00fdch pr\u016ftok\u016f, kter\u00fd slou\u017e\u00ed jako podklad pro na\u0159\u00edzen\u00ed vl\u00e1dy \u010cR, p\u0159in\u00e1\u0161\u00ed zcela jist\u011b oproti p\u016fvodn\u00edmu, ale st\u00e1le je\u0161t\u011b platn\u00e9mu metodick\u00e9mu pokynu z\u00a0roku 1998 z\u00e1sadn\u00ed zm\u011bny. Zvolen\u00fd p\u0159\u00edstup ve v\u011bt\u0161in\u011b p\u0159\u00edpad\u016f vede ke zv\u00fd\u0161en\u00ed po\u017eadavk\u016f na MZP oproti sm\u011brn\u00fdm hodnot\u00e1m, kter\u00e9 odpov\u00eddaj\u00ed po\u017eadavk\u016fm p\u016fvodn\u00edho metodick\u00e9ho pokynu z\u00a0roku 1998. Zp\u0159\u00edsn\u011bn\u00ed podm\u00ednek se t\u00fdk\u00e1 p\u0159edev\u0161\u00edm tok\u016f v\u00a0kategorii 4\u2008s\u00a0rozkol\u00edsan\u00fdm pr\u016ftokov\u00fdm re\u017eimem, kter\u00e1 podle navr\u017een\u00e9 regionalizace na \u00fazem\u00ed \u010cR plo\u0161n\u011b p\u0159eva\u017euje.<\/p>\n<p>Metodick\u00fd pokyn z\u00a0roku 1998 stanovuje hodnotu MZP p\u0159edev\u0161\u00edm na z\u00e1klad\u011b tabulky sm\u011brn\u00fdch hodnot, kdy je z\u00e1kladn\u00edm krit\u00e9riem hodnota Q<sub>355d<\/sub>. U\u017e samotn\u00fd pojem sm\u011brn\u00e9 hodnoty umo\u017e\u0148uje na jedn\u00e9 stran\u011b jistou flexibilitu p\u0159i stanoven\u00ed MZP, ale na stran\u011b druh\u00e9 je jasn\u00e9, \u017ee se jedn\u00e1 o\u00a0hrub\u00fd odhad, to metodick\u00fd pokyn s\u00e1m p\u0159izn\u00e1v\u00e1. Stanoven\u00ed MZP je rovn\u011b\u017e skokov\u00e9, co\u017e nen\u00ed spravedliv\u00e9 a\u00a0z\u00a0hydrologick\u00e9ho hlediska p\u0159\u00edli\u0161 logick\u00e9. Nicm\u00e9n\u011b, je to v\u011bc zvolen\u00e9ho p\u0159\u00edstupu odpov\u00eddaj\u00edc\u00ed sv\u00e9 dob\u011b. Dal\u0161\u00ed argument mluv\u00edc\u00ed v\u00a0neprosp\u011bch st\u00e1vaj\u00edc\u00edho p\u0159\u00edstupu je zalo\u017een na tvrzen\u00ed, \u017ee zmi\u0148ovan\u00e1 tabulka nebyla p\u016fvodn\u011b v\u016fbec odvozena pro stanoven\u00ed hodnot MZP, ale pro pot\u0159eby \u0159ed\u011bn\u00ed odpadn\u00edch vod pod \u010cOV. Ze strany org\u00e1n\u016f ochrany p\u0159\u00edrody jsou v\u0161eobecn\u011b hodnoty MZP vypl\u00fdvaj\u00edc\u00ed z\u00a0metodick\u00e9ho pokynu ch\u00e1p\u00e1ny jako n\u00edzk\u00e9 a\u00a0p\u0159\u00edstup je p\u0159\u00edli\u0161 flexibiln\u00ed.<\/p>\n<p>Nov\u011b zvolen\u00fd p\u0159\u00edstup je komplexn\u011bj\u0161\u00ed, ale to s\u00a0sebou samoz\u0159ejm\u011b p\u0159in\u00e1\u0161\u00ed \u0161ir\u0161\u00ed pohled na v\u011bc a\u00a0s\u00a0t\u00edm i\u00a0logick\u00e9 komplikace. Na z\u00e1klad\u011b zad\u00e1n\u00ed a\u00a0po\u017eadavku ze strany M\u017dP m\u011bl nov\u00fd p\u0159\u00edstup zohlednit hydrologickou variabilitu v\u00a0podob\u011b region\u00e1ln\u00edho rozd\u011blen\u00ed \u010cR respektuj\u00edc\u00ed hranice povod\u00ed. V\u00a0p\u0159\u00edpad\u011b nov\u00e9ho p\u0159\u00edstupu se jedn\u00e1 o\u00a0hranice povod\u00ed 4. \u0159\u00e1du. Auto\u0159i nov\u00e9ho p\u0159\u00edstupu si jsou zcela v\u011bdomi, \u017ee jak\u00fdkoli pokus o\u00a0region\u00e1ln\u00ed rozd\u011blen\u00ed plochy \u010cR z\u00a0hlediska hydrologick\u00e9 variability pro pot\u0159eby stanoven\u00ed MZP mus\u00ed b\u00fdt zat\u00ed\u017een jist\u00fdm zjednodu\u0161en\u00edm a\u00a0nelze postihnout v\u0161echny charakteristick\u00e9 typy povod\u00ed. Navrhovan\u00fd postup tak p\u0159isp\u00edv\u00e1 k\u00a0objektivn\u011bj\u0161\u00edmu stanoven\u00ed MZP.<\/p>\n<p>Hodnoty MZP jsou odvozeny tak, aby byl pom\u011br MZP\/Q<sub>a<\/sub> cca 25\u00a0%. Tento po\u017eadavek vyplynul z\u00a0po\u017eadavku na tzv. ekologick\u00fd pr\u016ftok, kter\u00fd byl uv\u00e1d\u011bn v\u00a0p\u016fvodn\u00edch textech dokument\u016f EU [7]. Zde je nutno poznamenat, \u017ee tento po\u017eadavek (doporu\u010den\u00ed) ji\u017e nen\u00ed v\u00a0dokumentech EU uv\u00e1d\u011bn, ale v\u00a0po\u017eadavc\u00edch na nov\u00fd metodick\u00fd p\u0159\u00edstup byl ponech\u00e1n.<\/p>\n<p>Z\u00a0hlediska sezonn\u00edho rozd\u011blen\u00ed MZP lze konstatovat, \u017ee rozd\u011blen\u00ed MZP b\u011bhem roku je zcela logick\u00e9 a\u00a0v\u00a0sousedn\u00edch (z\u00e1padn\u00edch) st\u00e1tech zcela b\u011b\u017en\u00e9. Je nutno poznamenat, \u017ee ji\u017e p\u016fvodn\u00ed metodick\u00fd pokyn doporu\u010doval rozd\u011blit z\u016fstatkov\u00fd pr\u016ftok sezonn\u011b b\u011bhem roku a\u00a0kladl zna\u010dn\u00fd d\u016fraz na vazbu s\u00a0biologi\u00ed, p\u0159edev\u0161\u00edm na ryby a\u00a0zoobentos.<\/p>\n<p>Sezonn\u00ed d\u011blen\u00ed MZP v\u0161ak s\u00a0sebou nese ur\u010dit\u00e9 provozn\u00ed komplikace, kter\u00e9 jsou spojeny p\u0159edev\u0161\u00edm s\u00a0vlastn\u00edm m\u011b\u0159en\u00edm obou sezonn\u00edch hodnot. Ob\u011b hodnoty se li\u0161\u00ed maxim\u00e1ln\u011b 10\u201320\u00a0%, a\u00a0to je z\u00a0hlediska m\u011b\u0159en\u00ed a\u00a0souvisej\u00edc\u00edch nejistot m\u00e1lo. Area distribution of change in the value of the MZP (proposal\/current value) \u2013 (main season)<\/h6>\n<p>Samostatnou kapitolu tvo\u0159\u00ed n\u00e1dr\u017ee, kde se hodnota MZP nestanovuje na z\u00e1klad\u011b metodick\u00e9ho pokynu, ale podle \u00fa\u010delu vodn\u00edho d\u00edla a\u00a0tedy na z\u00e1klad\u011b vodohospod\u00e1\u0159sk\u00e9ho \u0159e\u0161en\u00ed n\u00e1dr\u017ee. Z\u00a0hlediska stanoven\u00ed hodnot MZP je nemo\u017en\u00e9 odvodit univerz\u00e1ln\u00ed vzorec pro v\u00fdpo\u010det MZP, kter\u00fd by byl aplikovateln\u00fd na multifunk\u010dn\u00ed vodn\u00ed d\u00edla, nebo tato vodn\u00ed d\u00edla kategorizovat podle ur\u010dit\u00fdch parametr\u016f a\u00a0n\u00e1sledn\u011b pro n\u011b odvodit p\u0159\u00edslu\u0161n\u00fd algoritmus v\u00fdpo\u010dtu MZP. Jak\u00e9 \u0159e\u0161en\u00ed a\u00a0p\u0159\u00edstup zvolit? P\u0159esto\u017ee nov\u00e9 na\u0159\u00edzen\u00ed nebude m\u00edt zp\u011btnou platnost, je zde v\u00a0p\u0159\u00edpad\u011b n\u00e1dr\u017e\u00ed riziko, \u017ee v\u00a0r\u00e1mci p\u0159ehodnocen\u00ed manipula\u010dn\u00edho \u0159\u00e1du m\u016f\u017ee doj\u00edt i\u00a0k\u00a0p\u0159ehodnocen\u00ed MZP. To s\u00a0sebou nese riziko, \u017ee nov\u011b nastaven\u00fd MZP zp\u016fsob\u00ed probl\u00e9my z\u00a0hlediska zabezpe\u010denosti jednotliv\u00fdch funkc\u00ed n\u00e1dr\u017ee a\u00a0n\u00e1dr\u017e nebude schopna plnit svoji funkci nap\u0159. z\u00e1sobov\u00e1n\u00ed pitnou vodou. Aby k\u00a0t\u011bmto situac\u00edm nedoch\u00e1zelo, m\u011blo by na\u0159\u00edzen\u00ed vl\u00e1dy umo\u017enit v\u00fdjimku, kter\u00e1 by umo\u017enila stanovit MZP odpov\u00eddaj\u00edc\u00ed \u00fa\u010del\u016fm vodn\u00edho d\u00edla. Z\u00a0hlediska n\u00e1dr\u017e\u00ed je nutn\u00e9 se domn\u00edvat, \u017ee tuto v\u00fdjimku bude nutno uplatnit na v\u0161echny v\u00fdznamn\u011bj\u0161\u00ed n\u00e1dr\u017ee v\u00a0\u010cR.<\/p>\n<h2>Z\u00e1v\u011br<\/h2>\n<p>Z\u00e1v\u011brem lze konstatovat, \u017ee problematiku nov\u00e9ho zp\u016fsobu stanoven\u00ed MZP \u010dek\u00e1 jist\u011b zaj\u00edmav\u00e1 diskuse. Diskuse bude o\u00a0to zaj\u00edmav\u011bj\u0161\u00ed, \u017ee v\u00a0sou\u010dasnosti prob\u00edh\u00e1 meziresortn\u00ed p\u0159ipom\u00ednkov\u00e9 \u0159\u00edzen\u00ed.
