Hlavn\u00edm c\u00edlem politiky t\u00e9to sm\u011brnice je dosa\u017een\u00ed dobr\u00e9ho stavu vod. Tato sm\u011brnice p\u0159edstavuje pravd\u011bpodobn\u011b nejv\u00fdznamn\u011bj\u0161\u00ed legislativn\u00ed n\u00e1stroj v\u00a0oblasti vodn\u00ed politiky a\u00a0je z\u00e1rove\u0148 jednou z\u00a0nejslo\u017eit\u011bj\u0161\u00edch sm\u011brnic vytvo\u0159en\u00fdch na \u00farovni Evropsk\u00e9 unie (d\u00e1le jen EU). P\u0159ijet\u00ed sm\u011brnice p\u0159edstavovalo v\u00fdznamn\u00fd nov\u00fd impuls i\u00a0pro vodohospod\u00e1\u0159sk\u00e9 pl\u00e1nov\u00e1n\u00ed, kter\u00e9 m\u00e1 na \u00fazem\u00ed \u010cesk\u00e9 republiky dlouhou tradici. V\u00a0souvislosti s\u00a0p\u0159\u00edpravou nov\u00e9 \u010desk\u00e9 vodohospod\u00e1\u0159sk\u00e9 legislativy, kter\u00e1 reagovala na po\u017eadavek transpozice t\u00e9to sm\u011brnice do \u010desk\u00e9ho pr\u00e1vn\u00edho \u0159\u00e1du, byl\u00a0v\u00a0z\u00e1kon\u011b \u010d.\u00a0254\/2001 Sb., o\u00a0vod\u00e1ch a\u00a0o\u00a0zm\u011bn\u011b n\u011bkter\u00fdch z\u00e1kon\u016f (vodn\u00ed z\u00e1kon) zapracov\u00e1n zcela nov\u00fd syst\u00e9m vodohospod\u00e1\u0159sk\u00e9ho pl\u00e1nov\u00e1n\u00ed a\u00a0pro tento syst\u00e9m bylo zavedeno nov\u00e9 ozna\u010den\u00ed Pl\u00e1nov\u00e1n\u00ed v\u00a0oblasti vod.<\/p>\n<h2>Pl\u00e1nov\u00e1n\u00ed v\u00a0oblasti vod<\/h2>\n<p>Pl\u00e1nov\u00e1n\u00ed v\u00a0oblasti vod je soustavn\u00e1 koncep\u010dn\u00ed \u010dinnost, kterou podle vodn\u00edho z\u00e1kona zaji\u0161\u0165uje st\u00e1t a\u00a0kter\u00e1 implementuje po\u017eadavky R\u00e1mcov\u00e9 sm\u011brnice o\u00a0vod\u00e1ch. Hlavn\u00edm c\u00edlem politiky t\u00e9to sm\u011brnice je dosa\u017een\u00ed dobr\u00e9ho stavu vod do roku 2015\u2008s\u00a0mo\u017enost\u00ed prodlou\u017een\u00ed t\u00e9to lh\u016fty na maxim\u00e1ln\u011b dv\u011b n\u00e1sleduj\u00edc\u00ed aktualizace pl\u00e1n\u016f, kter\u00e9 prob\u00edhaj\u00ed v\u00a0\u0161estilet\u00fdch obdob\u00edch (dobr\u00e9ho stavu je tedy nutno dos\u00e1hnout do roku 2027, s\u00a0v\u00fdjimkou p\u0159\u00edpad\u016f, kdy p\u0159\u00edrodn\u00ed podm\u00ednky jsou takov\u00e9, \u017ee stanoven\u00fdch c\u00edl\u016f nem\u016f\u017ee b\u00fdt v\u00a0t\u011bchto obdob\u00edch dosa\u017eeno). Hlavn\u00ed n\u00e1stroj k\u00a0dosa\u017een\u00ed t\u011bchto c\u00edl\u016f p\u0159edstavuj\u00ed pl\u00e1ny povod\u00ed a\u00a0pl\u00e1ny pro zvl\u00e1d\u00e1n\u00ed povod\u0148ov\u00fdch rizik, resp. jimi stanoven\u00fd program opat\u0159en\u00ed. Tyto pl\u00e1ny jsou v\u00fdznamn\u00fdm podkladem pro v\u00fdkon ve\u0159ejn\u00e9 spr\u00e1vy, zejm\u00e9na pak pro \u00fazemn\u00ed pl\u00e1nov\u00e1n\u00ed a\u00a0vodopr\u00e1vn\u00ed \u0159\u00edzen\u00ed. P\u016fsobnost \u00fast\u0159edn\u00edho vodopr\u00e1vn\u00edho \u00fa\u0159adu ve v\u011bci sestavov\u00e1n\u00ed pl\u00e1n\u016f vykon\u00e1v\u00e1, podle vodn\u00edho z\u00e1kona, Ministerstvo zem\u011bd\u011blstv\u00ed a\u00a0Ministerstvo \u017eivotn\u00edho prost\u0159ed\u00ed.<\/p>\n<p>Proces pl\u00e1nov\u00e1n\u00ed se neobejde bez \u00fa\u010dinn\u00e9 koordinace \u0161irok\u00e9ho spektra z\u00fa\u010dastn\u011bn\u00fdch subjekt\u016f. Za t\u00edmto \u00fa\u010delem Ministerstvo zem\u011bd\u011blstv\u00ed v\u00a0roce 2003 ustanovilo Komisi pro pl\u00e1nov\u00e1n\u00ed v\u00a0oblasti vod a\u00a0fakticky t\u00edm odstartoval proces pl\u00e1nov\u00e1n\u00ed v\u00a0\u010cesk\u00e9 republice.<\/p>\n<p>Za \u00fa\u010delem zaji\u0161t\u011bn\u00ed koordinovan\u00e9ho p\u0159\u00edstupu p\u0159i prov\u00e1d\u011bn\u00ed R\u00e1mcov\u00e9 sm\u011brnice o\u00a0vod\u00e1ch na \u00farovni Evropsk\u00e9 unie byla uzav\u0159ena vz\u00e1jemn\u00e1 dohoda \u010dlensk\u00fdch st\u00e1t\u016f, Evropsk\u00e9 komise a\u00a0Norska na spole\u010dn\u00e9 implementa\u010dn\u00ed strategii (Common Implementation Strategy, d\u00e1le jen CIS) pro tuto sm\u011brnici, a\u00a0to ji\u017e v\u00a0kv\u011btnu 2001, tj.\u00a0jen p\u011bt m\u011bs\u00edc\u016f po vstupu sm\u011brnice v\u00a0platnost. Dal\u0161\u00edm z\u00a0d\u016fvod\u016f pro ustaven\u00ed CIS byl mimo jin\u00e9 i\u00a0fakt, \u017ee \u0159ada povod\u00ed v\u00fdznamn\u00fdch evropsk\u00fdch \u0159ek pokr\u00fdv\u00e1 \u00fazem\u00ed hned n\u011bkolika st\u00e1t\u016f (nap\u0159.\u00a0povod\u00ed \u0159eky Dunaje zahrnuje \u00fazem\u00ed 14 st\u00e1t\u016f) a\u00a0p\u0159es rozd\u00edln\u00e9 administrativn\u00ed a\u00a0\u00fazemn\u00ed \u010dlen\u011bn\u00ed je p\u0159\u00ednosn\u00fd spole\u010dn\u00fd a\u00a0koordinovan\u00fd p\u0159\u00edstup k\u00a0ochran\u011b vod, co\u017e p\u0159isp\u00edv\u00e1 k\u00a0efektivn\u00edmu a\u00a0\u00fasp\u011b\u0161n\u00e9mu prov\u00e1d\u011bn\u00ed t\u00e9to sm\u011brnice. P\u0159edev\u0161\u00edm z\u00a0t\u011bchto d\u016fvodu bylo do spole\u010dn\u00e9ho procesu zav\u00e1d\u011bn\u00ed RSV zapojeno krom\u011b \u010dlensk\u00fdch st\u00e1t\u016f EU, kandid\u00e1tsk\u00fdch zem\u00ed a\u00a0zem\u00ed EHP i\u00a0\u0159ada nevl\u00e1dn\u00edch organizac\u00ed a\u00a0dal\u0161\u00edch z\u00fa\u010dastn\u011bn\u00fdch subjekt\u016f.<\/p>\n<p>V\u00a0r\u00e1mci organiza\u010dn\u00ed struktury CIS byly ustaveny pracovn\u00ed skupiny, kter\u00e9 se zab\u00fdvaj\u00ed konkr\u00e9tn\u00edmi d\u00edl\u010d\u00edmi t\u00e9maty, kdy \u0159\u00edd\u00edc\u00edm org\u00e1nem v\u00a0r\u00e1mci CIS jsou \u201evodn\u00ed \u0159editel\u00e9\u201c, kte\u0159\u00ed na sv\u00fdch zased\u00e1n\u00edch schvaluj\u00ed v\u00fdstupy (nap\u0159.\u00a0sm\u011brn\u00e9 dokumenty EK (Guidance documents)\u00a0apod.) z\u00a0t\u011bchto pracovn\u00edch skupin. Koordina\u010dn\u00ed roli ve struktu\u0159e CIS zaji\u0161\u0165uje Strategick\u00e1 koordina\u010dn\u00ed skupina (SCG), kter\u00e1 koordinuje \u010dinnosti pracovn\u00edch skupin a\u00a0je pod\u0159\u00edzen\u00e1 gr\u00e9miu \u201evodn\u00edch \u0159editel\u016f\u201c EU. S\u00a0ohledem na sd\u00edlenou kompetenci ve vodn\u00edm hospod\u00e1\u0159stv\u00ed mezi rezorty Ministerstva \u017eivotn\u00edho prost\u0159ed\u00ed a\u00a0Ministerstva zem\u011bd\u011blstv\u00ed zastupuj\u00ed \u010cR dva \u201evodn\u00ed \u0159editel\u00e9\u201c, jako\u017eto z\u00e1stupci obou rezort\u016f.<\/p>\n<p>Po zaveden\u00ed Sm\u011brnice Evropsk\u00e9ho parlamentu a\u00a0Rady 2007\/60\/ES o\u00a0vyhodnocov\u00e1n\u00ed a\u00a0zvl\u00e1d\u00e1n\u00ed povod\u0148ov\u00fdch rizik (d\u00e1le jen Povod\u0148ov\u00e1 sm\u011brnice) byla do \u010dinnost\u00ed CIS zahrnuta tak\u00e9 koordinace povod\u0148ov\u00e9 ochrany na \u00farovni EU.<\/p>\n<p>V\u00a0sou\u010dasn\u00e9 dob\u011b, podle schv\u00e1len\u00e9ho pl\u00e1nu prac\u00ed na obdob\u00ed 2016\u20132018, struktura CIS zahrnuje p\u011bt tematick\u00fdch skupin v\u011bnuj\u00edc\u00edch se problematice ekologick\u00e9ho stavu\u00a0\u2013 pracovn\u00ed skupina ECOSTAT, chemick\u00fdm l\u00e1tk\u00e1m ve vodn\u00edm prost\u0159ed\u00ed\u00a0\u2013 pracovn\u00ed skupina Chemicals, podzemn\u00edm vod\u00e1m\u00a0\u2013 pracovn\u00ed skupina Groundwater, povod\u0148ov\u00e9 ochran\u011b\u00a0\u2013 pracovn\u00ed skupina Floods a\u00a0oblasti spr\u00e1vy dat a\u00a0reportingu\u00a0\u2013 pracovn\u00ed skupina Data and Information Sharing. Hlavn\u00edm v\u00fdstupem \u010dinnosti pracovn\u00edch skupin CIS bylo do sou\u010dasnosti vytvo\u0159en\u00ed v\u00edce ne\u017e t\u0159iceti sm\u011brn\u00fdch dokument\u016f a\u00a0\u0159ady technick\u00fdch dokument\u016f, kter\u00e9 slou\u017e\u00ed jako podp\u016frn\u00fd metodick\u00fd p\u0159\u00edstup, kter\u00fd je v\u0161ak v\u00a0\u0159ad\u011b oblast\u00ed pot\u0159eba p\u0159izp\u016fsobit specifick\u00fdm podm\u00ednk\u00e1m \u010dlensk\u00fdch st\u00e1t\u016f EU. V\u00a0neposledn\u00ed \u0159ad\u011b \u010dinnosti pracovn\u00edch skupin p\u0159isp\u00edvaj\u00ed k\u00a0vz\u00e1jemn\u00e9 v\u00fdm\u011bn\u011b zku\u0161enost\u00ed z\u00a0n\u00e1rodn\u00edch \u00farovn\u00ed, kter\u00e1 p\u0159isp\u00edv\u00e1 k\u00a0lep\u0161\u00ed koordinaci prov\u00e1d\u011bn\u00ed R\u00e1mcov\u00e9 sm\u011brnice o\u00a0vod\u00e1ch a\u00a0Povod\u0148ov\u00e9 sm\u011brnice.<\/p>\n<h2>Prvn\u00ed etapa procesu pl\u00e1nov\u00e1n\u00ed v\u00a0oblasti vod<\/h2>\n<p>Prvn\u00ed etapa procesu pl\u00e1nov\u00e1n\u00ed v\u00a0oblasti vod prob\u00edhala do roku 2015. V\u00a0letech 2004 a\u017e 2007 byl zpracov\u00e1n koncep\u010dn\u00ed dokument Pl\u00e1n hlavn\u00edch povod\u00ed \u010cesk\u00e9 republiky (d\u00e1le jen PHP). Tento dokument stanovoval dlouhodobou koncepci oblasti vod, integroval z\u00e1m\u011bry a\u00a0c\u00edle rezortn\u00edch politik \u00fast\u0159edn\u00edch vodopr\u00e1vn\u00edch \u00fa\u0159ad\u016f, zejm\u00e9na pak Koncepce vodohospod\u00e1\u0159sk\u00e9 politiky Ministerstva zem\u011bd\u011blstv\u00ed pro obdob\u00ed po vstupu do Evropsk\u00e9 unie na l\u00e9ta 2004\u20132010 a\u00a0St\u00e1tn\u00ed politiky \u017eivotn\u00edho prost\u0159ed\u00ed 2004\u20132010, a\u00a0stal se z\u00e1kladn\u00edm podkladem pro zpracov\u00e1n\u00ed pl\u00e1n\u016f oblast\u00ed povod\u00ed. PHP byl schv\u00e1len usnesen\u00edm vl\u00e1dy \u010cesk\u00e9 republiky ze dne 23.\u00a0kv\u011btna\u00a02007 \u010d.\u00a0562. Z\u00e1vazn\u00e1 \u010d\u00e1st PHP byla vyhl\u00e1\u0161ena na\u0159\u00edzen\u00edm vl\u00e1dy \u010d.\u00a0262\/2007 Sb.<\/p>\n<p>V\u00a0n\u00e1vaznosti na PHP bylo n\u00e1sledn\u011b zpracov\u00e1no osm pl\u00e1n\u016f oblast\u00ed povod\u00ed, kter\u00e9 byly schv\u00e1leny do 22.\u00a0prosince\u00a02009 jednotliv\u00fdmi kraji podle jejich \u00fazemn\u00ed p\u016fsobnosti. V\u00a0pl\u00e1nech oblast\u00ed povod\u00ed jsou uvedena v\u0161echna opat\u0159en\u00ed, je\u017e se m\u011bla v\u00a0p\u0159\u00edslu\u0161n\u00fdch povod\u00edch p\u0159ijmout k\u00a0dosa\u017een\u00ed dobr\u00e9ho stavu v\u0161ech vodn\u00edch \u00fatvar\u016f do roku 2015 ve smyslu c\u00edl\u016f dobr\u00e9ho ekologick\u00e9ho a\u00a0chemick\u00e9ho stavu \u00fatvar\u016f povrchov\u00fdch vod a\u00a0dobr\u00e9ho kvantitativn\u00edho a\u00a0chemick\u00e9ho stavu \u00fatvar\u016f podzemn\u00edch vod. Vodn\u00ed z\u00e1kon stanovil pro 1. cyklus pl\u00e1n\u016f, nad r\u00e1mec po\u017eadavk\u016f vypl\u00fdvaj\u00edc\u00edch z\u00a0R\u00e1mcov\u00e9 sm\u011brnice o\u00a0vod\u00e1ch, rovn\u011b\u017e c\u00edle v\u00a0ochran\u011b p\u0159ed povodn\u011bmi a\u00a0dal\u0161\u00edmi \u0161kodliv\u00fdmi \u00fa\u010dinky vod a\u00a0c\u00edle pro udr\u017eiteln\u00e9 u\u017e\u00edv\u00e1n\u00ed vodn\u00edch zdroj\u016f zejm\u00e9na pro \u00fa\u010dely z\u00e1sobov\u00e1n\u00ed pitnou vodou. Realizace program\u016f opat\u0159en\u00ed p\u0159ijat\u00fdch pl\u00e1ny oblast\u00ed povod\u00ed prob\u00edhala od roku 2010 do konce roku 2012.<\/p>\n<p>Sou\u010d\u00e1st\u00ed po\u017eadavk\u016f R\u00e1mcov\u00e9 sm\u011brnice o\u00a0vod\u011b, kter\u00e9 jsou na jednotliv\u00e9 \u010dlensk\u00e9 st\u00e1ty kladeny, je tak\u00e9 p\u0159ed\u00e1v\u00e1n\u00ed povinn\u00fdch zpr\u00e1v Evropsk\u00e9 komisi, tzv.\u00a0reporting. Tyto zpr\u00e1vy jsou n\u00e1sledn\u011b komis\u00ed vyhodnocov\u00e1ny a\u00a0souhrnn\u011b zpracov\u00e1ny do tzv.\u00a0implementa\u010dn\u00edch zpr\u00e1v, ve kter\u00fdch lze nal\u00e9zt souhrnn\u00e9 informace o\u00a0pokroku v\u00a0jednotliv\u00fdch \u010dlensk\u00fdch st\u00e1tech, ale tak\u00e9 c\u00edlen\u011b adresovan\u00e1 doporu\u010den\u00ed jednotliv\u00fdm zem\u00edm ke zlep\u0161en\u00ed prov\u00e1d\u011bn\u00ed identifikovan\u00fdch po\u017eadavk\u016f. O\u00a0p\u0159ijet\u00ed pl\u00e1n\u016f povod\u00ed byla tedy v\u00a0souladu s\u00a0t\u011bmito po\u017eadavky v\u00a0roce 2010 pod\u00e1na zpr\u00e1va Evropsk\u00e9 komisi. V\u00a0souladu s\u00a0\u010dl\u00e1nkem 15 odst.\u00a03) R\u00e1mcov\u00e9 sm\u011brnice o\u00a0vod\u00e1ch byla na konci roku 2012 n\u00e1sledn\u011b pod\u00e1na Evropsk\u00e9 komisi tak\u00e9 zpr\u00e1va o\u00a0pokroku dosa\u017een\u00e9m p\u0159i prov\u00e1d\u011bn\u00ed programu opat\u0159en\u00ed.<\/p>\n<p>Jeliko\u017e je \u010cR \u0159adu let tak\u00e9 smluvn\u00ed stranou \u0159ady mezin\u00e1rodn\u00edch smluv v\u00a0oblasti vodn\u00edho hospod\u00e1\u0159stv\u00ed, a\u0165 u\u017e na \u00farovni hrani\u010dn\u00edch vod se sousedn\u00edmi st\u00e1ty \u010cR, nebo ucelen\u00fdch mezin\u00e1rodn\u00edch povod\u00ed je nezbytn\u00e9 zaji\u0161\u0165ovat i\u00a0koordinaci zav\u00e1d\u011bn\u00ed po\u017eadavk\u016f v\u00fd\u0161e uveden\u00fdch sm\u011brnic i\u00a0v\u00a0mezin\u00e1rodn\u00edm kontextu.<\/p>\n<p>V\u00a0r\u00e1mci mezin\u00e1rodn\u00edch povod\u00ed \u0159ek Labe, Odry a\u00a0Dunaje, do kter\u00fdch \u00fazem\u00ed \u010cR n\u00e1le\u017e\u00ed, byly v\u00a0pr\u016fb\u011bhu 90. let 20. stolet\u00ed postupn\u011b ustaveny mezin\u00e1rodn\u00ed komise\u00a0\u2013 Mezin\u00e1rodn\u00ed komise pro ochranu Labe (MKOL), Mezin\u00e1rodn\u00ed komise pro ochranu Odry p\u0159ed zne\u010di\u0161t\u011bn\u00edm (MKOOpZ) a\u00a0Mezin\u00e1rodn\u00ed komise pro ochranu Dunaje (MKOD), kter\u00e9 se od sv\u00e9ho vzniku zam\u011b\u0159uj\u00ed na koordinovanou ochranu vod v\u00a0m\u011b\u0159\u00edtku mezin\u00e1rodn\u00edch povod\u00ed. Po nabyt\u00ed \u00fa\u010dinnosti R\u00e1mcov\u00e9 sm\u011brnice o\u00a0vod\u00e1ch se napl\u0148ov\u00e1n\u00ed po\u017eadavk\u016f t\u00e9to sm\u011brnice stalo postupn\u011b jedn\u00edm z\u00a0nosn\u00fdch t\u00e9mat. Vyvrcholen\u00ed spole\u010dn\u011b koordinovan\u00e9 \u010dinnosti procesu pl\u00e1nov\u00e1n\u00ed v\u00a0oblasti vod p\u0159edstavovalo v\u00a0roce 2009 schv\u00e1len\u00ed mezin\u00e1rodn\u00edch pl\u00e1n\u016f povod\u00ed pro ucelen\u00e1 povod\u00ed \u0159ek Labe, Odry a\u00a0Dunaje, v\u010detn\u011b ur\u010den\u00ed spole\u010dn\u00fdch nadregion\u00e1ln\u00edch c\u00edl\u016f v\u00a0ochran\u011b vod. Na po\u0159\u00edzen\u00ed t\u011bchto mezin\u00e1rodn\u00edch pl\u00e1n\u016f povod\u00ed se pod\u00edlela \u0159ada n\u00e1rodn\u00edch expert\u016f jednotliv\u00fdch smluvn\u00edch stran.<\/p>\n<p>Obecn\u011b lze v\u00a0tomto kontextu konstatovat, \u017ee se nepoda\u0159ilo v\u00a0obdob\u00ed do konce roku 2012 realizovat v\u0161echna pl\u00e1ny navr\u017een\u00e1 opat\u0159en\u00ed. Hlavn\u00ed p\u0159ek\u00e1\u017eky v\u00a0realizaci \u010di implementaci opat\u0159en\u00ed spo\u010d\u00edvaly nej\u010dast\u011bji v\u00a0obt\u00ed\u017en\u00e9m a\u00a0\u010dasov\u011b n\u00e1ro\u010dn\u00e9m vypo\u0159\u00e1d\u00e1n\u00ed komplikovan\u00fdch majetkopr\u00e1vn\u00edch vztah\u016f. Dal\u0161\u00ed v\u00fdznamnou p\u0159ek\u00e1\u017ekou bylo rovn\u011b\u017e nedostate\u010dn\u00e9 rozpracov\u00e1n\u00ed a\u00a0projektov\u00e1 p\u0159ipravenost jednotliv\u00fdch akc\u00ed. Tento fakt byl v\u00fdznamn\u011b spojen se skute\u010dnost\u00ed, \u017ee drobn\u00e9 vodn\u00ed toky (na kter\u00fdch byla v\u00a0t\u00e9to oblasti povod\u00ed p\u0159ev\u00e1\u017en\u00e1 \u010d\u00e1st opat\u0159en\u00ed k\u00a0zaji\u0161t\u011bn\u00ed odpov\u00eddaj\u00edc\u00edch hydromorfologick\u00fdch podm\u00ednek) p\u0159e\u0161ly z\u00a0gesce zru\u0161en\u00e9 Zem\u011bd\u011blsk\u00e9 vodohospod\u00e1\u0159sk\u00e9 spr\u00e1vy, kter\u00e1 byla do t\u00e9 doby spr\u00e1vcem drobn\u00fdch vodn\u00edch tok\u016f, na st\u00e1tn\u00ed podniky Povod\u00ed, p\u0159i\u010dem\u017e mnoho projekt\u016f nebylo do doby transformace z\u00e1sadn\u011b projektov\u011b rozpracov\u00e1no.<\/p>\n<h2>Druh\u00e1 etapa procesu pl\u00e1nov\u00e1n\u00ed v\u00a0oblasti vod<\/h2>\n<p>V\u00a0reakci na p\u0159ipom\u00ednky Evropsk\u00e9 komise (tzv.\u00a0infringement) k\u00a0ne\u00fapln\u011b proveden\u00e9 transpozici R\u00e1mcov\u00e9 sm\u011brnice o\u00a0vod\u00e1ch do\u0161lo v\u00a0roce 2010 k\u00a0novelizaci vodn\u00edho z\u00e1kona z\u00e1konem \u010d.\u00a0150\/2010 Sb., kter\u00fd rovn\u011b\u017e obsahoval transpozici sm\u011brnic 2006\/118\/ES o\u00a0ochran\u011b podzemn\u00edch vod p\u0159ed zne\u010di\u0161t\u011bn\u00edm a\u00a0zhor\u0161ov\u00e1n\u00edm stavu a\u00a0sm\u011brnice 2008\/105\/ES o\u00a0norm\u00e1ch environment\u00e1ln\u00ed kvality v\u00a0oblasti vodn\u00ed politiky. Pro druhou etapu procesu tak byla stanovena nov\u00e1 struktura zpracov\u00e1n\u00ed aktualizace pl\u00e1n\u016f povod\u00ed. Pl\u00e1ny povod\u00ed se ve druh\u00e9 etap\u011b po\u0159izovaly ve t\u0159ech \u00farovn\u00edch:<\/p>\n<ul>\n<li>pro mezin\u00e1rodn\u00ed oblasti povod\u00ed (d\u00e1le jen mezin\u00e1rodn\u00ed pl\u00e1ny povod\u00ed),<\/li>\n<li>pro \u010d\u00e1sti mezin\u00e1rodn\u00edch oblast\u00ed povod\u00ed na \u00fazem\u00ed \u010cesk\u00e9 republiky (d\u00e1le jen n\u00e1rodn\u00ed pl\u00e1ny povod\u00ed),<\/li>\n<li>pro d\u00edl\u010d\u00ed povod\u00ed.<\/li>\n<\/ul>\n<p>V\u00a0geografick\u00fdch a\u00a0hydrografick\u00fdch podm\u00ednk\u00e1ch \u010cR jsou po\u0159izov\u00e1ny t\u0159i n\u00e1rodn\u00ed pl\u00e1ny povod\u00ed (d\u00e1le jen NPP) a\u00a0deset pl\u00e1n\u016f d\u00edl\u010d\u00edch povod\u00ed (d\u00e1le jen PDP).<\/p>\n<p>Dal\u0161\u00ed v\u00fdznamnou sou\u010d\u00e1st\u00ed pl\u00e1nov\u00e1n\u00ed v\u00a0oblasti vod jsou od roku 2010 i\u00a0n\u00e1le\u017eitosti implementace Sm\u011brnice Evropsk\u00e9ho parlamentu a\u00a0Rady 2007\/60\/ES o\u00a0vyhodnocov\u00e1n\u00ed a\u00a0zvl\u00e1d\u00e1n\u00ed povod\u0148ov\u00fdch rizik. \u00da\u010delem t\u00e9to sm\u011brnice je stanovit r\u00e1mec pro vyhodnocov\u00e1n\u00ed a\u00a0zvl\u00e1d\u00e1n\u00ed povod\u0148ov\u00fdch rizik s\u00a0c\u00edlem sn\u00ed\u017eit nep\u0159\u00edzniv\u00e9 \u00fa\u010dinky na lidsk\u00e9 zdrav\u00ed, \u017eivotn\u00ed prost\u0159ed\u00ed, kulturn\u00ed d\u011bdictv\u00ed a\u00a0hospod\u00e1\u0159skou \u010dinnost, kter\u00e9 souvisej\u00ed s\u00a0povodn\u011bmi. Podle po\u017eadavk\u016f t\u00e9to sm\u011brnice jsou po\u0159izov\u00e1ny Pl\u00e1ny pro zvl\u00e1d\u00e1n\u00ed povod\u0148ov\u00fdch rizik (d\u00e1le jen PpZPR).<\/p>\n<p>V\u00fdznamn\u00e9 v\u011bcn\u00e9 vstupy pro p\u0159\u00edpravu druh\u00e9ho pl\u00e1novac\u00edho obdob\u00ed p\u0159edstavovaly i\u00a0tzv.\u00a0implementa\u010dn\u00ed zpr\u00e1vy Evropsk\u00e9 komise. V\u00a0souladu s\u00a0\u010dl\u00e1nkem 18 R\u00e1mcov\u00e9 sm\u011brnice o\u00a0vod\u011b bylo povinnost\u00ed Evropsk\u00e9 komise zve\u0159ejnit zpr\u00e1vu Evropsk\u00e9mu parlamentu a\u00a0Rad\u011b o\u00a0prov\u00e1d\u011bn\u00ed t\u00e9to sm\u011brnice, a\u00a0to nejpozd\u011bji do 22.\u00a0prosince\u00a02012 (v\u00a0po\u0159ad\u00ed \u0161lo celkem ji\u017e o\u00a0t\u0159et\u00ed implementa\u010dn\u00ed zpr\u00e1vu). Tato zpr\u00e1va zahrnovala mj. p\u0159ezkoum\u00e1n\u00ed pokroku p\u0159i implementaci sm\u011brnice a\u00a0hodnocen\u00ed pl\u00e1n\u016f povod\u00ed p\u0159edlo\u017een\u00fdch v\u00a0souladu s\u00a0\u010dl\u00e1nkem 15 v\u010detn\u011b doporu\u010den\u00ed pro zlep\u0161en\u00ed budouc\u00edch pl\u00e1n\u016f.<\/p>\n<p>Tato zpr\u00e1va byla p\u0159ijata dne 14.\u00a0listopadu\u00a02012 a\u00a0skl\u00e1dala se ze samotn\u00e9 Zpr\u00e1vy komise Evropsk\u00e9mu parlamentu a\u00a0Rad\u011b o\u00a0prov\u00e1d\u011bn\u00ed R\u00e1mcov\u00e9 sm\u011brnice o\u00a0vod\u011b\u00a0\u2013 pl\u00e1ny povod\u00ed COM (2012) 670, d\u00e1le z\u00a0pracovn\u00edho dokumentu komise (tzv.\u00a0European Overview) a\u00a0z\u00a0posouzen\u00ed pl\u00e1n\u016f povod\u00ed specifick\u00e9ho pro jednotliv\u00e9 zem\u011b.<\/p>\n<p>V\u00a0kontextu t\u00e9to zpr\u00e1vy a\u00a0navazuj\u00edc\u00edch aktivit Evropsk\u00e9 komise ke zv\u00fd\u0161en\u00ed kvality n\u00e1vrhu pl\u00e1n\u016f povod\u00ed pro druh\u00fd pl\u00e1novac\u00ed cyklus se dne 29.\u00a0ledna\u00a02014 uskute\u010dnilo bilater\u00e1ln\u00ed jedn\u00e1n\u00ed z\u00e1stupc\u016f \u010cR a\u00a0Evropsk\u00e9 komise v\u00a0Bruselu. V\u00fdsledkem tohoto jedn\u00e1n\u00ed bylo vymezen\u00ed probl\u00e9mov\u00fdch aspekt\u016f vypl\u00fdvaj\u00edc\u00edch z\u00a0prvn\u00edho pl\u00e1novac\u00edho cyklu a\u00a0stanoven\u00ed konkr\u00e9tn\u00edch krok\u016f (tzv.\u00a0actions) k\u00a0jejich n\u00e1prav\u011b.<\/p>\n<p>Prozat\u00edm posledn\u00ed implementa\u010dn\u00ed zpr\u00e1va Evropsk\u00e9 komise (v\u00a0po\u0159ad\u00ed \u010dtvrt\u00e1), p\u0159ijat\u00e1 dne 9.\u00a0b\u0159ezna\u00a02015, zahrnovala posouzen\u00ed pokroku p\u0159i prov\u00e1d\u011bn\u00ed program\u016f opat\u0159en\u00ed navr\u017een\u00fdch \u010dlensk\u00fdmi st\u00e1ty v\u00a0pl\u00e1nech povod\u00ed pro prvn\u00ed pl\u00e1novac\u00ed cyklus. Pr\u016fb\u011b\u017en\u00e1 zpr\u00e1va byla zalo\u017eena na anal\u00fdze zpr\u00e1v p\u0159edlo\u017een\u00fdch \u010dlensk\u00fdmi st\u00e1ty v\u00a0souladu s\u00a0\u010dl\u00e1nkem 15.3 a\u00a0obsahovala tak\u00e9 n\u00e1vrhy na zlep\u0161en\u00ed program\u016f opat\u0159en\u00ed, kter\u00e1 m\u011bla b\u00fdt za\u0159azena do aktualizace pl\u00e1n\u016f povod\u00ed pro druh\u00fd pl\u00e1novac\u00ed cyklus.<\/p>\n<p>Pro zaji\u0161t\u011bn\u00ed koordinace p\u0159\u00edpravy jednotliv\u00fdch n\u00e1rodn\u00edch pl\u00e1n\u016f povod\u00ed, d\u00edl\u010d\u00edch pl\u00e1n\u016f povod\u00ed a\u00a0pl\u00e1n\u016f pro zvl\u00e1d\u00e1n\u00ed povod\u0148ov\u00fdch rizik byla, obdobn\u011b jako pro p\u0159\u00edpravu pl\u00e1n\u016f povod\u00ed pro prvn\u00ed pl\u00e1novac\u00ed obdob\u00ed, Ministerstvem zem\u011bd\u011blstv\u00ed a\u00a0Ministerstvem \u017eivotn\u00edho prost\u0159ed\u00ed z\u0159\u00edzena Komise pro pl\u00e1nov\u00e1n\u00ed v\u00a0oblasti vod. \u010cleny t\u00e9to skupiny byli z\u00e1stupci \u00fast\u0159edn\u00edch spr\u00e1vn\u00edch \u00fa\u0159ad\u016f, do jejich\u017e p\u016fsobnosti spadaj\u00ed jednotliv\u00e9 oblasti maj\u00edc\u00ed vztah k\u00a0pl\u00e1nov\u00e1n\u00ed v\u00a0oblasti vod, krajsk\u00fdch \u00fa\u0159ad\u016f, Asociace kraj\u016f \u010cR, spr\u00e1vc\u016f povod\u00ed, Lesy \u010cR,\u00a0st\u00e1tn\u00edch podnik\u016f, v\u00fdznamn\u00fdch vodohospod\u00e1\u0159sk\u00fdch instituc\u00ed, Agentury ochrany p\u0159\u00edrody a\u00a0krajiny, \u010cesk\u00e9 inspekce \u017eivotn\u00edho prost\u0159ed\u00ed, v\u00fdznamn\u00fdch u\u017eivatel\u016f vod i\u00a0nevl\u00e1dn\u00edch organizac\u00ed. Do Komise pro pl\u00e1nov\u00e1n\u00ed v\u00a0oblasti vod byla za\u010dlen\u011bna i\u00a0pracovn\u00ed skupina pro implementaci Povod\u0148ov\u00e9 sm\u011brnice, kter\u00e1 byla zalo\u017eena Ministerstvem \u017eivotn\u00edho prost\u0159ed\u00ed v\u00a0roce 2008. Koordinace na mezin\u00e1rodn\u00ed \u00farovni je zaji\u0161t\u011bna zapojen\u00edm \u010cR v\u00a0r\u00e1mci \u010dinnosti mezin\u00e1rodn\u00edch komis\u00ed v\u00a0jednotliv\u00fdch mezin\u00e1rodn\u00edch povod\u00edch.<\/p>\n<p>Pr\u00e1ce na aktualizaci pl\u00e1n\u016f povod\u00ed pro druh\u00fd pl\u00e1novac\u00ed cyklus prob\u00edhaly v\u00a0obdob\u00ed 2011\u20132015. V\u00a0r\u00e1mci p\u0159\u00edpravn\u00fdch prac\u00ed byly p\u0159ezkoum\u00e1ny a\u00a0aktualizov\u00e1ny c\u00edle a\u00a0programy opat\u0159en\u00ed k\u00a0jejich napln\u011bn\u00ed. Na z\u00e1klad\u011b nov\u00e9 typologie povrchov\u00fdch vod do\u0161lo rovn\u011b\u017e k\u00a0v\u00fdznamn\u00e9mu p\u0159evymezen\u00ed \u00fatvar\u016f povrchov\u00fdch vod, d\u00e1le byly zm\u011bn\u011bny hodnoty (a\u00a0v\u00a0n\u011bkter\u00fdch p\u0159\u00edpadech i\u00a0ukazatele) velmi dobr\u00e9ho, dobr\u00e9ho a\u00a0st\u0159edn\u00edho stavu v\u0161eobecn\u00fdch fyzik\u00e1ln\u011b\u00ad\u2011chemick\u00fdch slo\u017eek ekologick\u00e9ho stavu\/potenci\u00e1lu a\u00a0zm\u011bnil se i\u00a0rozsah a\u00a0kvalita monitorovan\u00fdch dat. Po\u010det sledovan\u00fdch m\u011brn\u00fdch profil\u016f a\u00a0vodn\u00edch \u00fatvar\u016f se zv\u011bt\u0161il a\u00a0v\u00fdznamn\u011b narostl rozsah sledov\u00e1n\u00ed biologick\u00fdch slo\u017eek. Proto bylo mo\u017eno ve druh\u00e9m pl\u00e1novac\u00edm obdob\u00ed na z\u00e1klad\u011b dat z\u00a0monitoringu hodnotit i\u00a0ty vodn\u00ed \u00fatvary, jejich\u017e stav musel b\u00fdt v\u00a0prvn\u00edm pl\u00e1novac\u00edm obdob\u00ed hodnocen jin\u00fdmi postupy, nebo na z\u00e1klad\u011b expertn\u00edho odhadu.<\/p>\n<p>Od doby vypracov\u00e1n\u00ed pl\u00e1n\u016f povod\u00ed pro prvn\u00ed pl\u00e1novac\u00ed cyklus v\u00a0roce 2009 do\u0161lo v\u00a0r\u016fzn\u00fdch kategori\u00edch povrchov\u00fdch vod t\u00e9m\u011b\u0159 pro v\u0161echny slo\u017eky biologick\u00e9 kvality k\u00a0metodick\u00fdm \u00faprav\u00e1m postup\u016f hodnocen\u00ed. Zm\u011bn doznal i\u00a0postup identifikace siln\u011b ovlivn\u011bn\u00fdch vodn\u00edch \u00fatvar\u016f (hlavn\u011b tekouc\u00edch vod) a\u00a0metody hodnocen\u00ed ekologick\u00e9ho potenci\u00e1lu.<\/p>\n<p>V\u00a0p\u0159\u00edpad\u011b chemick\u00e9ho stavu \u00fatvar\u016f povrchov\u00fdch vod do\u0161lo na evropsk\u00e9 \u00farovni ke zm\u011bn\u00e1m limit\u016f dobr\u00e9ho stavu pro \u010d\u00e1st ukazatel\u016f, pop\u0159. ke zm\u011bn\u011b matrice. Pro \u00fa\u010dely hodnocen\u00ed chemick\u00e9ho stavu \u00fatvar\u016f podzemn\u00edch vod vzrostl po\u010det hodnocen\u00fdch ukazatel\u016f a\u00a0oproti prvn\u00edmu pl\u00e1novac\u00edmu obdob\u00ed byly v\u00edce zohledn\u011bny dal\u0161\u00ed receptory, s\u00a0\u010d\u00edm\u017e souvis\u00ed zp\u0159\u00edsn\u011bn\u00ed limit\u016f dobr\u00e9ho stavu. Stejn\u011b jako u\u00a0povrchov\u00fdch vod byl v\u00fdznamn\u011b zlep\u0161en monitoring, a\u00a0to jak z\u00a0hlediska zv\u00fd\u0161en\u00ed po\u010dtu monitorovac\u00edch m\u00edst, tak z\u00a0hlediska sledov\u00e1n\u00ed dal\u0161\u00edch ukazatel\u016f.<\/p>\n<p>P\u0159\u00edprava aktualizace pl\u00e1n\u016f povod\u00ed form\u00e1ln\u011b vyvrcholila schv\u00e1len\u00edm NPP vl\u00e1dou \u010cesk\u00e9 republiky dne 21.\u00a0prosince\u00a02015. V\u00a0souladu s\u00a0vodn\u00edm z\u00e1konem byly NPP n\u00e1sledn\u011b vyd\u00e1ny Ministerstvem zem\u011bd\u011blstv\u00ed jako opat\u0159en\u00ed obecn\u00e9 povahy, kter\u00e9 nabylo \u00fa\u010dinnosti 28.\u00a0ledna\u00a02016.<\/p>\n<p>PpZPR byly schv\u00e1leny vl\u00e1dou \u010cesk\u00e9 republiky dne 21.\u00a0prosince\u00a02015. V\u00a0souladu s\u00a0vodn\u00edm z\u00e1konem byly PpZPR n\u00e1sledn\u011b vyd\u00e1ny Ministerstvem \u017eivotn\u00edho prost\u0159ed\u00ed jako opat\u0159en\u00ed obecn\u00e9 povahy, kter\u00e9 vstoupilo v\u00a0platnost 19.\u00a0ledna\u00a02016. Jednotliv\u00e9 PDP byly postupn\u011b schv\u00e1leny v\u00a0prvn\u00ed polovin\u011b roku 2016 jednotliv\u00fdmi kraji podle jejich \u00fazemn\u00ed p\u016fsobnosti. NPP, PpZPR i\u00a0PDP proch\u00e1zely rovn\u011b\u017e spole\u010dn\u00fdm posouzen\u00edm vlivu koncepce na \u017eivotn\u00ed prost\u0159ed\u00ed (SEA) v\u00a0souladu se z\u00e1konem \u010d.\u00a0100\/2001 Sb., o\u00a0posuzov\u00e1n\u00ed vliv\u016f na \u017eivotn\u00ed prost\u0159ed\u00ed, ve zn\u011bn\u00ed pozd\u011bj\u0161\u00edch p\u0159edpis\u016f.<\/p>\n<p>Dnem schv\u00e1len\u00ed pl\u00e1n\u016f pro druhou etapu procesu pl\u00e1nov\u00e1n\u00ed v\u00a0oblasti vod zapo\u010dala realizace programu opat\u0159en\u00ed, kter\u00e9 tyto pl\u00e1ny p\u0159ijaly. Realizaci opat\u0159en\u00ed je nutno uskute\u010dnit do 3\u00a0let od schv\u00e1len\u00ed pl\u00e1n\u016f, tj. do 22.\u00a0prosince\u00a02018. O\u00a0p\u0159ijet\u00ed pl\u00e1n\u016f povod\u00ed byla v\u00a0roce 2016 pod\u00e1na zpr\u00e1va Evropsk\u00e9 komisi v\u00a0souladu s\u00a0\u010dl\u00e1nkem 15 sm\u011brnice.<\/p>\n<p>V\u00a0mezin\u00e1rodn\u00edm kontextu byly i\u00a0ve\u00a0druh\u00e9m pl\u00e1novac\u00edm obdob\u00ed vz\u00e1jemn\u011b koordinov\u00e1ny kroky k\u00a0prov\u00e1d\u011bn\u00ed po\u017eadavk\u016f R\u00e1mcov\u00e9 sm\u011brnice o\u00a0vod\u00e1ch v\u00a0ucelen\u00fdch povod\u00edch \u0159ek Labe, Odry a\u00a0Dunaje. I\u00a0na \u00farovni mezin\u00e1rodn\u00edch komis\u00ed MKOL, MKOOpZ a\u00a0MKOD bylo zohledn\u011bno nabyt\u00ed \u00fa\u010dinnosti Sm\u011brnice Evropsk\u00e9ho parlamentu a\u00a0Rady 2007\/60\/ES o\u00a0vyhodnocov\u00e1n\u00ed a\u00a0zvl\u00e1d\u00e1n\u00ed povod\u0148ov\u00fdch rizik, kdy v\u00a0r\u00e1mci p\u0159\u00edpravn\u00fdch prac\u00ed procesu pl\u00e1nov\u00e1n\u00ed v\u00a0oblasti vod byly zah\u00e1jeny koordinovan\u00e9 pr\u00e1ce na zpracov\u00e1n\u00ed mezin\u00e1rodn\u00edch pl\u00e1n\u016f pro zvl\u00e1d\u00e1n\u00ed povod\u0148ov\u00fdch rizik. Koordinace \u010dinnost\u00ed v\u00a0p\u0159\u00edprav\u011b tohoto pl\u00e1novac\u00edho obdob\u00ed v\u00a0mezin\u00e1rodn\u00edch povod\u00edch byly \u00fasp\u011b\u0161n\u011b zakon\u010deny schv\u00e1len\u00edm aktualizovan\u00fdch mezin\u00e1rodn\u00edch pl\u00e1n\u016f povod\u00ed a\u00a0prvn\u00edch mezin\u00e1rodn\u00edch pl\u00e1n\u016f pro zvl\u00e1d\u00e1n\u00ed povod\u0148ov\u00fdch rizik.
